Littler Shareholder Tammy McCutchen testified in a recent hearing conducted by the House's Subcommittee on Workforce Protections that the Wage and Hour Division (WHD) has shifted its focus. Instead of helping employers with their good faith efforts to comply with the Fair Labor Standards Act, it would appear the WHD is focusing its efforts on extensive and often unnecessary enforcement actions. The Fair Labor Standards Act (FLSA) affects an estimated 135 million workers and 7 million employment establishments nationwide. In recent years, the WHD has adopted a more punitive enforcement agenda. These actions are alarming employers who are already frustrated with the federal law.
