Henderson Brothers HBInsights RSS Feed Henderson Brothers: HBInsights RSS Feed https://www.hendersonbrothers.com/henderson-brothers-blog <![CDATA[U.S. Supreme Court Hears Arguments on Health Care Reform]]> For three days during the week of March 26th, the U.S. Supreme Court heard testimony about the Patient Protection and Affordable Care Act (PPACA). The Court's consideration of this polarizing legislation is one of the most anticipated cases in recent history.  The "main event" with respect to testimony, is the constitutionality of the individual health insurance mandate. On the last day of oral arguments the Court focused on whether the remainder of PPACA could stand if the individual health insurance mandate is struck down.

Attempting to predict the outcome in the Supreme Court is difficult under any circumstances, especially in this case because there are so many potential outcomes.  The Court could vote to uphold all aspects of the health reform legislation, the Court could strike down the individual mandate, or the Justices could rule the entire law invalid, finding that the mandate cannot be severed from the rest of health care reform because the Exchanges, the "play or pay" penalty and several other features of the Act are too closely tied to the mandate to survive the mandate's invalidation.   The Justices could even pass for now, concluding that the Anti-Injunction Act precludes judicial consideration of the mandate until penalties are assessed, which would push this issue out to the year 2015.

<![CDATA[Henderson Brothers' "FLSA Seminar: Are your employees really exempt?" Recap]]> It's likely that you've heard some buzz about our recent seminars...

On February 15 at the Four Points Sheraton Pittsburgh North, Henderson Brothers partnered with Littler Mendelson to bring clients and prospects a free FLSA seminar worth 2 CE credits.  The seminar, titled, "FLSA Seminar: Are your employees really exempt?" reviewed common overtime exemptions & requirements, employer trends for classifying employees, and identified tips for conducting in-house audits to determine if an employee is entitled to overtime. Robert W. Pritchard and Jill M. Albrecht, representing Littler Mendelson, presented. The seminar was moderated by Henderson Brothers' Director of Compliance, Shari Herrle.

 

"I had been doing quite a bit of reading over the past year and felt that the FLSA subject matter was very timely and relevant for our clients and prospects. I requested that Littler be involved in the seminar and they jumped at the opportunity," said Shari Herrle.

 

Response for the seminar was overwhelming, with over 80 people in attendance! The FLSA Seminar was the first of four seminars in Henderson Brothers' 2012 Seminar Series. Keep an eye out for our next seminar which is projected to be held in May!

<![CDATA[New Jersey Wage & Hour Update - "Inside Sales" Exemption]]> The New Jersey Department of Labor and Workforce Development (DLWD) amended its wage and hour regulations in September 2011 to eliminate inconsistencies between state and federal overtime law. In so doing, the DLWD inadvertently omitted the exemption for commissioned sales employees, commonly referred to as the "inside sales" exemption, from the amendment. The DLWD's mistake, which it acknowledged was inadvertent, potentially put employers at risk for misclassification lawsuits. 

Now, however, the DLWD has corrected its error, and on February 21, 2012, the exemption was fully restored. The regulation now defines "administrative" employee to include an employee whose: (1) primary duty is sales; (2) total compensation is comprised of at least 50% commissions; and (3) total compensation is $400 or more per week. 

Notably, the restored New Jersey "inside sales" exemption differs from the exemptions available under federal law. As a result, employers should carefully analyze whether their commissioned sales employees qualify as exempt under both state and federal law.

<![CDATA[HBI Takes on the Pittsburgh Marathon...Again]]> For the second year in a row, Henderson Brothers, Inc. will be taking on the Dick's Sporting Goods' Pittsburgh Marathon!  Recently we were presented with the "Run for a Reason" trophy for having the highest percentage of participation of all of the corporate sponsors for Gilda's Club of Western Pennsylvania in 2011.  Furthermore, we are extremely proud to have raised over $3,000 for Gilda's Club through various fundraisers last year.  HBI is poised to make another run at the trophy again this year, and we hope to exceed the $3,000 we raised last year!

<![CDATA[California Wage Theft Prevention Act: New Wage Notice]]> Companies who employ California employees have one more disclosure they must provide.  Add this new Act to the very long list of legislation that already exists...California's Wage Theft Prevention Act of 2011 went into effect on January 1, 2012.  One of the Act's new statutes requires employers to give new employees a specific notice about their wages and other employment-related information.  This new wage notice must also be provided to current employees in certain circumstances.   According to attorneys at Littler Mendelson P.C., there are still some unanswered questions regarding this new Notice.
