The Departments have issued another set of FAQs regarding health care reform’s Summary of Benefits and Coverage (SBC) requirement. The agencies explain that the aim of the FAQs is to answer some of the questions that have been raised over the past few months.

Health Reform’s summary of benefits and coverage (SBC) is a significant disclosure requirement imposed on insurers, group health plans and ultimately, plan sponsors. This new SBC applies to all insurers and group health plans, even those plans that are considered grandfathered programs with respect to health reform. The DOL, HHS, and IRS in a collaborative effort have just recently issued final regulations and related guidance implementing this SBC requirement. These regulations finalize, with some important changes, the original proposed regulations and related guidance that was originally issued back in August 2011.

On January 3, 2012, the IRS released Notice 2012-09, which amends and restates interim guidance produced in Notice 2011-28 that was issued last year. The 2011 Notice was a FAQ; this new Notice adds eight more questions along with revising some of the answers produced in the earlier FAQ Notice.

On December 16, 2011, HHS issued a bulletin outlining the methodology it intends to follow while defining the “essential health benefits package”. As a result of Health Reform, beginning in 2014, non-grandfathered health plans in the individual and small group markets, both inside and outside the Exchanges, must ensure that benefit coverage includes the “essential health benefits” (EHB).

On December 2, 2011, the Department of Health and Human Services (HHS) released a final rule that addresses an assortment of issues with respect to the PPACA medical loss ratio (MLR) requirements. In conjunction with the new HHS final rule, the DOL has issued a Technical Release as well.

When the proposed SBC regulations were released originally in August 2011, the regulators identified at that time that changes would be required. The DOL, HHS and IRS have jointly issued a new FAQ (Part VII) that addresses health care reform’s summary of benefits and coverage (SBC).
