Plan Sponsor Medicare Part D Disclosure DON’Ts

Don’t fail to comply with Medicare Part D requirements because Medicare Secondary Payer (MSP) rules do not apply to your group health plan;

 

Don’t assume your insurer or TPA has provided all the required disclosure notices;

 

Don’t assume that because your plan does not offer health coverage to retirees that your plan covers no one eligible for Medicare Part D;

 

Don’t fail to provide disclosure notices to HRA participants with no other group health plan coverage;

 

Don’t fail to provide disclosure notices to Medicare eligible health plan participants 30 days earlier this year — by October 14th;

 

Don’t fail to provide updated disclosure notices to participants when your health plan coverage changes from creditable to non-creditable or vice versa;

 

Don’t fail to complete the Disclosure to CMS Form on the CMS website when your health plan coverage changes from creditable to non-creditable or vice versa;

 

Don’t fail to complete the Disclosure to CMS Form on the CMS website annually within 60 days after the beginning date of your Plan year.
